Welcome to Way2Cure Medical Equipment! These Terms & Conditions ("Terms") govern your access to and use of the Way2Cure website `[www.way2cure.com/]` and all services, products, and content provided by Way2Cure (referred to as "we", "us", or "our") for buying and renting medical equipment.
By accessing, Browse, or using our website and services, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and all applicable laws and regulations. If you do not agree with any part of these Terms, you must not use our website or services.
1. Acceptance of Terms
By creating an account, making a purchase, renting equipment, or otherwise using our services, you confirm your acceptance of these Terms. These Terms constitute a legally binding agreement between you and Way2Cure.
2. User Eligibility and Accounts
Our services are available only to individuals who can form legally binding contracts under applicable law. By using our services, you represent that you are at least 18 years old and have the legal capacity to enter into agreements.
- Account Creation: You may need to register for an account to access certain features. You agree to provide accurate, current, and complete information during registration and keep your account information updated.
- Account Security: You are responsible for maintaining the confidentiality of your account password and are fully responsible for all activities that occur under your account.
- Prohibited Use: You agree not to use our services for any unlawful or prohibited activities.
3. Product Sales & Rentals
Way2Cure offers medical equipment for both purchase and rental. Specific terms apply to each:
- Product Descriptions: We strive to provide accurate product descriptions, images, and specifications. However, we do not warrant that product descriptions or other content is accurate, complete, reliable, current, or error-free.
- Pricing: All prices are listed in Indian Rupees (INR) unless otherwise specified and are subject to change without notice. Applicable taxes and shipping/rental charges will be added at checkout.
- Availability: Product availability is subject to change. We reserve the right to limit the quantity of items purchased or rented per customer.
- Purchase Terms:
- All sales are final unless otherwise stated in our Refund & Return Policy.
- Title to purchased products passes to you upon delivery.
- Rental Terms:
- Rental periods, rates, security deposits, and extension policies are clearly outlined on each product's rental page.
- You are responsible for the proper use and care of rented equipment. Damage beyond normal wear and tear will incur charges against your security deposit or require additional payment.
- Late returns may incur additional rental fees.
- Equipment remains the property of Way2Cure at all times.
4. Payment, Billing, and Refunds
All payments are processed securely through third-party payment gateways. By providing payment information, you represent that you are authorized to use the payment method and authorize us to charge you for the total amount of your order/rental.
- Billing Information: You agree to provide current, complete, and accurate purchase and account information.
- Refunds & Cancellations: Our Refund & Cancellation Policy, available on a separate page `[link to Refund Policy page, e.g., base_url('refund-policy')]`, governs all refund and cancellation processes for both purchases and rentals.
5. Delivery and Shipping
We aim to deliver products and equipment within the estimated timeframe. However, delivery times are estimates and not guarantees.
- Delivery Charges: Applicable delivery charges will be displayed at checkout.
- Inspection Upon Delivery: You are responsible for inspecting products upon delivery and reporting any damage or discrepancies within `[e.g., 24-48]` hours.
- Risk of Loss: Risk of loss and title for items purchased pass to you upon our delivery to the carrier. For rented items, risk of loss remains with Way2Cure, but you are liable for loss or damage due to your negligence or misuse.
6. Warranties and Guarantees
Way2Cure acts as a reseller or rental provider. Product warranties are typically provided by the original manufacturer. We do not offer direct warranties beyond those expressly stated. For rental equipment, we guarantee equipment will be in good working order at the time of delivery.
Way2Cure disclaims all other warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose.
7. Limitation of Liability
To the fullest extent permitted by law, Way2Cure shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the services; (b) any conduct or content of any third party on the services; or (c) unauthorized access, use, or alteration of your transmissions or content.
8. Intellectual Property
All content on the Way2Cure website, including text, graphics, logos, images, software, and the compilation thereof, is the property of Way2Cure or its content suppliers and protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent.
9. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts located in Navi Mumbai, Maharashtra, India.
10. Indemnification
You agree to indemnify, defend, and hold harmless Way2Cure, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that such parties may incur as a result of or arising from your (or anyone using your account's) violation of these Terms.
11. Changes to Terms & Conditions
We reserve the right to modify or replace these Terms at any time, at our sole discretion.
